Most people don't know how to use a VPN, but it should theoretically work, unless they went the extra mile and blocked VPNs too

Ok, but this warning seems to be done on the app side. Hypothetically, given that Tiktok is a Chinese company, they could just ignore the ban and then the US government would have to force ISPs to block connections to Tiktok.
